Under Saudi practice, there are two levels of enforcement of IP rights, (1) enforcement before Saudi Authority for Intellectual Property (“SAIP”) where the aggrieved party should submit an online complaint, SAIP would examine the complaint and raid the target. SAIP may refer the complaint to the Public Prosecution to initiate criminal proceedings before court if the raided target proved to be infringing and (2) enforcement before courts of law, in which case, the aggrieved party should submit a statement of claim before court, the court would set up hearing to examine the case and issue order. Overall, enforcement before SAIP and courts of law will not take a long time. The Saudi Laws of Trademark, Patent, design, and copyright have set the minimum legal standards with respect to the enforcement of intellectual property rights.
